เหตุสุดวิสัย:: force majeure; inevitable event

เหตุสุดวิสัย ตามพจนานุกรมไทย: พจนานุกรม ฉบับราชบัณฑิตยสถาน พ.ศ. ๒๕๔๒ ถือว่า เหตุสุดวิสัย เป็น ภาวะที่พ้นความสามารถที่ใครจะป้องกันได้ events/risks/situations beyond the reasonable control / an event beyond human control.


ในภาษาอังกฤษ คำที่ให้ความหมายในทำนองหรือในเชิง "เหตุสุดวิสัย" ได้แก่ force majeure; inevitable event ; vis major (Latin) ; act of God ; cas fortuit ; casus fortuitus ; unexpected event(s); unavoidable accident คำเหล่านี้ มีนิยามความหมายในเชิง "เหตุสุดวิสัย" ทั้งสิ้น

เมื่อ"เหตุสุดวิสัย" force majeure; inevitable event ; vis major (Latin) ; cas fortuit ; casus fortuitus เป็นภาวะที่พ้นความสามารถที่ใครจะป้องกันได้ เช่น สงคราม war, ประท้วง strike, จราจล riot, อาชญากรรม crime, บริษัทประกันต่าง ๆ จะยกเหตุการณ์ ที่เป็นเหตุสุดวิสัยดังกล่าวเป็นข้อยกเว้นในการรับทำประกัน

"เหตุสุดวิสัย" ที่เป็น act of God เช่น พายุเฮอริเคน hurricane, น้ำท่วม flooding, แผ่นดินไหว earthquake, ภูเขาไฟระเบิด volcanic eruption เหตุสุดวิสัยเหล่านี้ทำให้ข้อกำหนดตามสัญญาต้องระงับไป Act of God prevents one or both parties from fulfilling their obligations under the contract.

ในการประชุมรัฐสภา การที่ผู้แทนราษฎรเสียบบัตรแทนกันไม่ถือเป็นเหตุการที่เรียกว่า เหตุสุดวิสัย In parliament meeting, representatives using other representatives' voting cards cannot be considered force majeure.

มันเป็นเหตุการณ์"เหตุสุดวิสัย"หรือคุณจงใจ Was it force majeure or you set it up this inevitable event??

นี่มันไม่เป็นเหตุการณ์"เหตุสุดวิสัย เพราะมันไม่ใช่สงคราม ประท้วง หรือ จราจล "It wasn't considered force majeure as it was not war, protest, or riots.

ในทางทหาร force majeure จะให้ความหมายแตกต่างออกไปบ้าง Force majeure, in the military, has a slightly different meaning. ซึ่ง force majeure จะหมายถึงเหตุการณ์ไม่ว่าจะเป็นที่ภายนอกหรือภายใน ที่เรือหรืออากาศยานได้รับอนุญาตให้เข้าพื้นที่หวงห้ามโดยไม่ถูกโทษทางวินัย It refers to an event, either external or internal, that happens to a vessel or aircraft that allows it to enter normally restricted areas without penalty.
